Introduction :- Our society works according to some rules and laws and under those rules and laws, an atmosphere of peace and harmony is maintained in the society.  Laws and constitution are made in any country for this harmony of the society to run creatively.  Breaking these rules made by the constitution is a punishable offence.  The punishment for this crime depends on the seriousness of that crime.  There is also a provision for capital punishment for the conviction of any serious crime.  The conflict between the constitution of the country and the rights of human beings has always been a matter of discussion.  In order to maintain the constitutional law and human rights of the society, there is a provision of death penalty for the punishment of some serious crimes.  Under this law, after proving the crime, the culprit is punished.  Due to which anger and such serious criminal incidents can be curbed.


What is capital punishment:- When a person is proved guilty of his crime under the legal process, his death sentence is called "death penalty".  Death penalty is also known by many other names like- Death Penalty and Capital Punishment.  Under this, some brutal crimes like murder, mass murder, rape, sexual abuse, terrorism, war crimes, treason, etc. come under the punishment of death penalty.  It is a social concept that with the passage of time the process of penal legislation also softens and the oldest punishment in vogue gradually goes out of vogue.  It is the belief of human society that society becomes civilized with time and there should not be such a law in a civilized society which is not in favor of the civilization of that civilized society.  The death sentence is also tested in this criterion.


Types of death penalty: In the Indian Penal Code, the crime of murder has been described in two categories - one is intentional and the other is unintentional murder.  Killing done knowingly and intentionally is classified as premeditated murder, and murder committed in self-defense or in circumstances giving rise to it is classified as culpable homicide.  Keeping in mind the circumstances of the murder, its heinousness, cruelty etc., the judge pronounces the punishment for that crime.  Whether the murder is intentional or unintentional, considering its seriousness, its punishment is death sentence.  Hanging, lethal injection, stoning, firing, electrocution, etc. are some of the special methods of executing capital punishment.  Over time, the death penalty has been abolished in many countries, and in many countries there is still a provision for capital punishment to maintain law and order, such as India, China, Saudi Arabia, Egypt, Pakistan, United States, Nigeria  , Japan, Iran, etc. in other countries, the provision of death sentence is there even today.


History of capital punishment in India:- Capital punishment is known all over the world as the biggest punishment given to a person for his crime.  Its practice is very old in Indian history, but for some time there has been a lot of talk about abolishing the provision of capital punishment.  The Constitution of India was implemented in the year 1950.  Earlier, the death penalty was given easily in the British rule.  In the first five years of the implementation of the Indian Constitution, there was a provision of capital punishment for anyone for his serious crime, because the provision of capital punishment was in vogue at that time.  After this, some changes were made in the punishment of their crimes.  In the Indian Constitution, the process of punishing a criminal was started keeping in mind the brutality of his crime.  Keeping in mind the brutality of the criminal person, the punishment for his crime was completed in life imprisonment or death sentence.


Some positive aspects of capital punishment:- We all know that capital punishment is the last and topmost punishment to be given to a criminal.  A person who commits a crime is a criminal in law, and is punished for his crimes.  If a person is given capital punishment for his crimes, then his crime will also be of high quality which will prove to be harmful for the public and the society.  Some experts believe that regarding the death penalty, this belief is also displayed in the society that there is always bad with bad and there is always good with good.

Prevention of criminal activity:- Any criminal is punished with capital punishment for the heinous crime committed by him.  This type of punishment sends a message to the criminals and the society that we should not commit such crimes.  A message to the criminals and people of the society and a fear is created in their mind.  By giving the death penalty, it becomes in the mind of the criminals that if we destroy someone's life or harm his life in any way, then we will get the punishment in the form of death penalty.  The fear of this punishment acts as a deterrent to their criminal activities.


End of criminals:- Death penalty brings an end to the cruel and unwanted criminals of the society, who commit such heinous crimes or imagine such crimes.  The death penalty puts an end to all those who are criminals and those who have this type of criminal thinking.  If a criminal is sentenced to life imprisonment instead of death penalty for such a heinous crime, then such criminals can harm the people inside or outside the jail by staying inside the jail.  Due to which such criminal cases are also promoted.  Keeping such criminals in jail also harms our government.  There is also a loss of money given to them for other works of our society.  By not giving death penalty to such criminals and keeping them in jail, the fear of criminals having this type of criminal tendency ends and they work to carry out such criminal incidents in the society.


Some positive facts in favor of death penalty:- The supporters of death penalty believe that the death penalty has been retained not only in India but also in liberal democratic countries like America.  To end it by citing "civilized country" can be proved very wrong.  Death penalty is the only judicial and ultimately correct decision for heinous crimes like murder, rape.  This can also kill the thoughts of criminals having the notion of such crime in their mind.  The parties in support of death penalty believe that a person who commits such a heinous crime takes away the right to live one's life.  Therefore it is the right decision to give him death instead.  This gives justice to the victim.  The punishment of death penalty should not be judged by the criminals but by its effect on those who hold such views in the society.


Some negative aspects:- It is often seen that many innocent people are killed due to our faulty judicial system and judicial authority.  Due to this type of system, an innocent person becomes guilty, and does not succeed in proving himself innocent.  Because of which he gets the death penalty.  It is right to kill someone or to give death sentence as a punishment to the culprit who commits the murder.  Some parties believe that this act is equivalent to the act of murder.  That's why many countries have been in favor of abolishing the death penalty.  Some parties believe that criminals must be given a second chance to live and improve their lives.  By giving a chance to the criminals, they will realize their criminal incident and by staying in jail, they can regret their criminal incident.


Conclusion:- Capital punishment is the best punishment for those who commit heinous crimes and extraordinary crimes.  It has been prevalent in all the civilizations of the world.  From time immemorial, the punishment of capital punishment was torture and painful.  There is a need for a significant change in the constitutional system and law and order of the present time, so that the culprits are punished and fear can be instilled in the minds of those who hold such views and our society can be freed from such crimes.
